In 2004, the South African Supreme Court upheld a cherem against a Johannesburg businessman for refusing to pay alimony to his former wife, as ordered by The Johannesburg Beth Din.  In India, marriage contracts are very rare and have no laws in place. However, with rising divorce rates, people are becoming more and more interested in it. Some lawyers believe that prenups in India have no legal sanctity. However, in some cases, some form of contract is signed, usually among affluent citizens. But agreements must be reasonable and not violate existing laws such as the Hindu Marriage Act. Indian courts allow the signing of a settlement protocol during divorces. In a 1990 California case, the Court of Appeals imposed an oral marriage contract on the estate of one of the parties, with the surviving spouse significantly changing his or her position by relying on the oral agreement. Even in states that have not adopted the UPAA/UPMAA, such as New York, duly executed marriage contracts enjoy the same presumption of legality as any other contract.
