One of the key aspects of the ATC is the provision in Article 6 on a special transitional protection mechanism to protect Members from injurious increases in imports during the transitional period of products that have not yet been integrated into the GATT and are not yet under quotas. This clause is based on a two-step approach: first, the importing Member must find that total imports of a given product are causing serious injury or a real threat to its domestic industry and, second, it must decide which Member States can be attributed to that serious injury. Specific criteria and procedures are defined for each step. The importing member must then consult the executive member(s).
